27 V.S.A. § ___ § 1335
Comparable housing
Operative Text
The declarant may offer a tenant assistance in locating comparable housing. If, as a result, the tenant obtains comparable housing, the tenant may be required upon 90 days’ notice to vacate the premises. (Added 1985, No. 175 (Adj. Sess.), § 5.)
Under 27 V.S.A. ch. 15 § 1335, when a property is being converted to a condominium or similar ownership form, the declarant (the party making the conversion) has the option to help a tenant find comparable replacement housing. If that assistance results in the tenant actually securing comparable housing, the declarant may then require the tenant to leave the current premises, but only after providing at least 90 days' written notice to vacate.
Plain English — not legal advice.
Under 27 V.S.A. ch. 15 § 1335, a declarant who chooses to assist a tenant in locating comparable housing should document that assistance and any resulting placement carefully. If the tenant successfully obtains comparable housing through that process, the declarant may issue a notice to vacate, but that notice must provide a minimum of 90 days before the tenant is required to leave. Operators generally maintain clear records of communications and housing referrals to demonstrate that the comparable-housing process was followed properly.

Section 27 V.S.A. ch. 15 § 1335 establishes that a declarant's ability to require you to vacate based on comparable housing is conditional — it applies only if you actually obtained comparable housing as a result of the declarant's assistance. If you receive a notice to vacate under this provision, you have at least 90 days before you are required to leave. Tenants who have questions about whether a notice was properly issued under this section may wish to consult a tenant-rights organization or legal aid service familiar with Vermont condominium conversion law.
