9 V.S.A. § ___ § 4466
Required disclosure; model form
Operative Text
(a) A landlord shall disclose in advance of entering a rental agreement with a tenant whether any portion of the premises offered for rent is located in a Federal Emergency Management Agency mapped special flood hazard area. This notice shall be provided to the tenant at or before execution of the lease in a separate written document substantially in the form prescribed by the Department of Housing and Community Development pursuant to subsection (b) of this section. (b) The Department of Housing and Community Development shall develop a model form for the notice provided under this section that shall include the information required under subsection (a) of this section. (Added 2023, No. 181 (Adj. Sess.), § 103, eff. June 17, 2024.)
Under 9 V.S.A. ch. 137 § 4466, Vermont landlords are required to inform prospective tenants before a rental agreement is signed whether any part of the rental property falls within a FEMA-designated special flood hazard area. This disclosure must be delivered as a separate written document, using a form that substantially follows the model developed by the Vermont Department of Housing and Community Development. The rule ensures that flood-risk information is communicated clearly and in a standardized way before a tenant is bound by a lease.

Under 9 V.S.A. ch. 137 § 4466, compliant landlords check whether their rental property is located within a FEMA-mapped special flood hazard area before marketing or leasing the unit. They prepare a separate written disclosure document that substantially follows the model form issued by the Vermont Department of Housing and Community Development, and they deliver that document to the prospective tenant at or before lease signing. Keeping a signed copy of the disclosure in the tenant's file is a common practice for documenting that the requirement was met.

Section 4466 of Title 9 of the Vermont Statutes gives tenants the right to receive written notice of flood hazard status before signing a lease, using a standardized form developed by the Vermont Department of Housing and Community Development. If a landlord did not provide this disclosure before the rental agreement was executed, that omission may be relevant to any dispute about the tenancy or the condition of the premises. Tenants who believe this requirement was not followed can consult a tenant-rights organization or contact the Vermont Department of Housing and Community Development to understand available options.
