CVR 11-020-003 § 4
ESTABLISHING THE CHANGE IN THE CONSUMER PRICE INDEX
Operative Text
4.1 The Department shall establish on an annual basis the percent that is one percentage point above the change in the Consumer Price Index, as defined in Subsection 2.2 above. 4.2 The Department shall find the annual change in the U.S. Consumer Price Index for all Urban Consumers, Housing Component, published by the U.S. Bureau of Labor Statistics in the periodical “Monthly Labor Review and Handbook of labor Statistics,” or its successor index, for the twelve-month period ending in August of each year. The percent change in the Consumer Price Index shall be rounded to the first decimal place, or tenth of a percent. 4.3 The Department shall then add one percentage point to the percent change in the Consumer Price Index and provide the result to all mobile home park owners and leaseholders’ advocates, along with an updated Notice of Proposed Mobile Home Park Lot Rent Increase form. The Department shall make the updated Notice available as soon as possible after the first business day in October. The percent result shall be the threshold that is used to determine whether or not leaseholders in a park may request mediation of a lot rent increase effective during the following calendar year.
Under CVR 11-020-003 § 4, Vermont's Department calculates an annual rent-increase threshold for mobile home park lot rents by finding the twelve-month change in the U.S. Consumer Price Index for Urban Consumers (Housing Component) through August, rounding it to one decimal place, and adding one percentage point. This resulting figure is distributed to mobile home park owners and leaseholders' advocates each October, along with an updated Notice of Proposed Mobile Home Park Lot Rent Increase form. The threshold determines whether leaseholders have the right to request mediation when their lot rent is proposed to increase in the following calendar year.
Plain English — not legal advice.
Mobile home park owners subject to CVR 11-020-003 § 4 should expect to receive the Department's annual CPI-based threshold and an updated Notice of Proposed Mobile Home Park Lot Rent Increase form shortly after the first business day in October each year. Compliant operators generally use the official Notice form when communicating proposed lot rent increases and are aware of whether their proposed increase falls above or below the published threshold, since that determines leaseholders' mediation rights. Keeping records of the received threshold figures and using the current-year Notice form are practices consistent with operating within this regulatory framework.

CVR 11-020-003 § 4 establishes the annual percentage threshold that gives mobile home park leaseholders the right to request mediation when a proposed lot rent increase exceeds it. If a park owner proposes a lot rent increase for the coming calendar year, leaseholders can compare that increase to the Department's published threshold—distributed each October—to determine whether mediation may be available to them. Tenant-rights organizations and leaseholders' advocates, who are among the recipients of the Department's annual notice under this provision, can be a useful resource for understanding how the threshold applies and what mediation options may exist.
