CVR 11-020-002 § 9
9.1 Owner Responsibility. A mobile home park owner shall not prohibit or hinder
the removal of household waste by a resident or any contractor hired by a resident. A
mobile home park owner may provide trash, recyclables, and food scraps removal,
however, residents’ use of such service shall not be required as a condition of the lease.
Nothing in this rule shall affect reasonable obligations concerning the removal of
household waste that may be set forth in a lease.

9.2 Resident Responsibility. Household waste that is placed outside a mobile home
shall be stored in animal-proof (to the extent feasible), watertight receptacles of metal or
other durable materials with tight-fitting covers and shall be removed and disposed of
properly. A resident shall not accumulate or store household waste anywhere on the lot,
under the mobile home or in any structure. Nothing in this rule shall affect reasonable
obligations concerning the removal of household waste that may be set forth in a lease.

Plain English

CVR 11-020-002 § 9 establishes a two-sided framework for household waste management in Vermont mobile home parks. On one side, park owners are barred from blocking or interfering with a resident's ability to arrange their own trash removal, and any owner-provided waste service cannot be made a mandatory lease condition. On the other side, residents are required to store household waste in animal-proof, watertight, covered receptacles and to dispose of it properly, without allowing waste to accumulate on the lot, under the home, or in any structure.

For Property Managers

Under CVR 11-020-002 § 9, compliant mobile home park operators generally refrain from restricting or obstructing a resident's chosen method of waste removal, whether the resident handles it personally or hires a contractor. If the park offers trash, recyclables, or food-scrap collection services, operators structure those services as optional rather than mandatory lease terms. Lease provisions addressing waste removal remain permissible as long as they reflect reasonable obligations consistent with the rule.

For Tenants

CVR 11-020-002 § 9 gives residents the right to arrange their own household waste removal without interference from the park owner, and protects them from being required to use any owner-provided waste service as a condition of their lease. Residents are also responsible for storing waste in proper covered, animal-proof, watertight containers and removing it promptly without letting it accumulate on the lot or under the home. If a park owner appears to be violating these sanitation provisions, residents may consider contacting the Vermont Department of Housing and Community Development or a local tenant-rights organization to understand available complaint and enforcement paths.
