CVR 11-020-002 § 5 establishes that mobile home park residents bear responsibility for maintaining their premises in a habitable condition consistent with Vermont's habitability standards under 10 V.S.A. § 6262(a). Residents are prohibited from intentionally or carelessly damaging, defacing, or removing fixtures, mechanical systems, utility systems, or furnishings, and this prohibition extends to guests, invitees, and household members. Additionally, any planting of vegetation or trees, or changes to lot landscaping, requires prior written approval from the park owner, though that approval cannot be withheld without reasonable grounds.

For Property Managers

Under CVR 11-020-002 § 5, mobile home park owners and managers generally maintain documentation of the lot's condition at move-in and throughout the tenancy to establish a baseline for any fixture, utility, or landscaping disputes. Operators typically have a written process for handling landscaping approval requests, ensuring responses are provided in a timely manner and that any denial is grounded in a legitimate, articulable reason. Keeping clear records of approvals, denials, and the condition of mechanical and utility systems helps demonstrate compliance with the habitability standards referenced in this provision.

For Tenants

CVR 11-020-002 § 5 outlines residents' obligations regarding property condition and landscaping in Vermont mobile home parks, but it also creates a framework that can inform how disputes are evaluated. If a park owner attempts to hold a resident responsible for damage caused by a guest or household member, understanding the scope of this provision — and whether the damage was deliberate or negligent — may be relevant to how the matter is addressed. Residents who believe a landscaping approval has been unreasonably withheld may wish to consult a tenant-rights organization or Vermont legal aid resource familiar with mobile home park regulations for general information about available options.
