CVR 11-020-002 § 13
PREMISES
Operative Text
13.1 Owner Responsibility. A mobile home park owner shall maintain or remove trees as necessary to ensure that they do not create any hazard, danger to persons, or damage to property. A mobile home park owner shall provide adequate drainage to prevent standing pools of water, erosion, or sink holes, and to mitigate flooding to the greatest extent feasible. 13.2 Resident Responsibility. Residents shall notify the park owner of any hazardous, dangerous, or damaging trees promptly. Unless the lease provides otherwise, residents are responsible for snow removal from parking spaces and walkways on their lot.
CVR 11-020-002 § 13 establishes a division of responsibility for physical conditions within a mobile home park. Park owners are required to manage trees that could pose hazards and to maintain drainage systems that prevent standing water, erosion, sinkholes, and flooding to the greatest extent feasible. Residents, in turn, carry a duty to promptly report dangerous trees to the owner and, unless their lease states otherwise, to handle snow removal from parking spaces and walkways on their own lot.
Plain English — not legal advice.
Under CVR 11-020-002 § 13, compliant mobile home park operators generally conduct regular inspections of trees throughout the park and address any that present hazards to people or property through maintenance or removal. They also maintain drainage infrastructure—such as grading, culverts, or retention features—designed to prevent standing water, erosion, sinkholes, and flooding to the greatest extent feasible. Operators typically document these efforts and review lease agreements to clarify whether snow removal responsibilities on individual lots have been shifted to residents.

CVR 11-020-002 § 13 gives mobile home park residents a clear right to a park environment where hazardous trees are managed and drainage is properly maintained by the owner. Residents have a corresponding duty to promptly notify the park owner when they observe a tree that appears hazardous, dangerous, or likely to cause property damage. If an owner fails to meet their obligations under this provision, residents may consider contacting Vermont's relevant housing or code-enforcement authorities, or reaching out to a tenant-rights organization to understand available options.
