CVR 11-020-002 § 12
ROADS
Operative Text
12.1 Owner Responsibility. A mobile home park owner shall maintain roads within the mobile home park (“park roads”) reasonably free from hazards and in a manner that ensures safe and reliable ingress, egress and use without unreasonable interruption on a year-round basis, including the adequate and timely removal of snow and mitigation of icy conditions. Park roads shall be maintained reasonably free of potholes or depressions in which surface water can accumulate and constitute a health and safety hazard. A mobile home park owner may establish rules pertaining to use of park roads by residents and their guests. 12.2 Resident Responsibility. Residents shall not damage, alter or block any park roads and shall not use park roads in any manner that could endanger any person or property. Pedestrians shall have the right of way over motor vehicles.
CVR 11-020-002 § 12 establishes a dual responsibility framework for roads within mobile home parks in Vermont. Park owners are required to keep roads safe, accessible, and usable throughout the entire year — including snow removal, ice mitigation, and pothole repair — while also retaining the authority to set rules for road use by residents and guests. Residents, in turn, are prohibited from damaging, altering, or blocking park roads, and pedestrians are granted the right of way over motor vehicles on those roads.

Under CVR 11-020-002 § 12, compliant mobile home park operators maintain park roads in a condition that allows safe and uninterrupted access year-round, addressing seasonal hazards such as snow, ice, and standing water in potholes promptly and adequately. Operators typically document their road maintenance activities — including snow removal schedules and pothole repairs — to demonstrate ongoing compliance with the year-round safety standard. Park owners may also draft and distribute written rules governing how residents and guests use park roads, provided those rules are consistent with the regulation's requirements.

CVR 11-020-002 § 12 gives mobile home park residents the right to safe, reliable, and unobstructed access to park roads throughout the year, including during winter conditions. If a park owner fails to maintain roads free of hazards such as ice, snow accumulation, or dangerous potholes, residents may have grounds to raise that failure as a violation of this provision by filing a complaint with the Vermont Agency of Commerce and Community Development or a relevant local authority. Tenant-rights organizations in Vermont can help residents understand what documentation to gather and what options may be available when road conditions fall short of the standard set by § 12.
