CVR 11-020-001 § 9
MOBILE HOME PARK RESIDENT OBLIGATIONS
Operative Text
9.1 Compliance with Regulations. A resident shall not act in any way which will cause the mobile home park to be out of compliance with building, environmental or housing or health regulations. 9.2 Peaceful Enjoyment. A resident shall not act or allow his or her guests or invitees to act in a manner which would disturb other residents’ peaceful enjoyment of the mobile home park. 9.3 No Destruction. A resident shall not deliberately or negligently destroy, deface, damage or remove any part of the mobile home park or its fixtures, mechanical or utility systems or furnishings, nor deliberately or negligently allow another to do so. 9.4 Subletting. No leaseholder may rent or sell his or her mobile home or sublease, or assign a lease, for the mobile home lot without the express permission of the park owner, which shall not be unreasonably withheld. 9.5 Notice of termination. A leaseholder may terminate a lease by delivering written notice to the park owner of the termination date at least one rental payment period prior to the termination date, unless inconsistent with a written lease. 9.6 Penalties. In addition to eviction, a park owner may seek court-ordered damages, costs and reasonable attorneys’ fees for violation of the obligations set forth in 10 V.S.A. § 6261.
CVR 11-020-001 § 9 sets out a series of behavioral and procedural obligations that mobile home park residents must follow. These include not disrupting neighbors' peaceful enjoyment, not damaging park property or infrastructure, and not subletting or assigning a lot lease without the park owner's express (and not unreasonably withheld) permission. Residents who wish to end their tenancy must provide written notice at least one rental payment period in advance, and violations of these obligations can expose a resident to court-ordered damages, costs, and attorneys' fees in addition to eviction.

Under CVR 11-020-001 § 9, compliant park operators document any resident conduct that causes regulatory non-compliance, disturbs neighbors, or results in damage to park property or systems. When a subletting or lease-assignment request is received, operators respond in a timely manner and avoid withholding permission without a reasonable basis, as the rule explicitly prohibits unreasonable denial. For lease violations, § 9.6 allows park owners to pursue court-ordered damages, costs, and reasonable attorneys' fees beyond eviction, so operators generally maintain clear records of incidents and communications to support any such claim.

CVR 11-020-001 § 9 outlines the conduct standards mobile home park residents are expected to meet, including keeping the peace, protecting park infrastructure, and seeking written permission before subletting or assigning a lot lease — permission that cannot be unreasonably withheld. Residents who want to end their tenancy have the right to do so by delivering written notice at least one rental payment period before the termination date, unless a written lease sets a different standard. If a park owner pursues damages or attorneys' fees under § 9.6, tenants may wish to consult a tenant-rights organization or legal aid service to understand what defenses or procedural rights may be available to them.
