CVR 11-020-001 § 8
If, after 30 days’ written notice, a park owner fails to repair a minor defect, or cure
noncompliance with the Mobile Home Park Act, or noncompliance with a material provision of
the lease which has occurred due to no fault of the leaseholder, the leaseholder may repair the
minor defect and deduct the actual and reasonable cost thereof from rent next due, up to one-half
of one month’s rent. Repair of a minor defect or noncompliance shall not include major work on
the park’s water, septic, or electrical systems. The leaseholder shall provide the park owner an
itemization of the deduction along with the rental payment, and shall be responsible for any
damage to property of the park owner caused by such repairs or attempts to repair.

Plain English

Under CVR 11-020-001 § 8, when a mobile home park owner has been given at least 30 days of written notice but still has not fixed a minor defect, corrected a violation of the Mobile Home Park Act, or remedied a lease breach that was not the leaseholder's fault, the leaseholder is permitted to arrange the repair themselves and subtract the actual, reasonable cost from the next rent payment — up to a ceiling of one-half of one month's rent. This self-help remedy does not extend to major work on the park's water, septic, or electrical systems. The leaseholder must accompany the reduced rent payment with an itemized breakdown of the deduction and remains responsible for any property damage caused during the repair effort.

For Property Managers

Park owners and managers operating under CVR 11-020-001 § 8 generally respond promptly to written repair notices so that the 30-day window does not expire and trigger a leaseholder's right to self-help repair. Compliant operators keep records of all written notices received and document any repair work completed within that period. When a leaseholder does submit a reduced payment with an itemization, operators typically review the deduction against the one-half-of-one-month's-rent cap and address any claimed property damage through the appropriate channels.

For Tenants

CVR 11-020-001 § 8 gives leaseholders in Vermont mobile home parks a specific self-help remedy: after delivering written notice and waiting 30 days without a fix, a leaseholder may hire someone to address a qualifying minor defect or lease/Act noncompliance and deduct the documented cost from rent, subject to the stated cap. This remedy does not cover major infrastructure work on water, septic, or electrical systems, so understanding whether a problem qualifies is an important first step. Leaseholders who want to understand how this provision applies to their circumstances can reach out to a tenant-rights organization, Vermont Legal Aid, or consult the Vermont Department of Housing and Community Development for guidance on the Mobile Home Park Act.
