La. Stat. Ann. § R.S. 40:528
Disclosure to residents and applicants; limitations
Operative Text
§528. Disclosure to residents and applicants; limitations Any applicant or recipient of assistance from a housing authority may examine his or her individual file or files at reasonable times and intervals. However, a local housing authority shall have no obligation to disclose to any resident or recipient of assistance any information pertaining to any investigation or confidential law enforcement activity relating to possible criminal misconduct on the part of such person.
Under La. R.S. § 40:528, individuals who apply for or receive assistance from a Louisiana housing authority have the right to review their own personal files held by that authority, provided they do so at reasonable times and intervals. At the same time, the law carves out a clear exception: housing authorities are not required to share information tied to investigations or confidential law enforcement activities concerning possible criminal misconduct by that same individual. The rule balances a general right of file access against a specific limitation designed to protect the integrity of law enforcement processes.
Plain English — not legal advice.
As operators of housing authority properties or programs governed by La. R.S. § 40:528, housing authorities and their managers generally maintain procedures that allow applicants and residents to schedule file reviews at reasonable times. Compliant operators also maintain clear internal policies identifying which records fall under the law enforcement exception, so that staff can consistently and correctly withhold only those materials that qualify. Documenting the basis for any withheld information helps demonstrate that access decisions align with the statute's requirements.

La. R.S. § 40:528 gives applicants and recipients of housing authority assistance the right to inspect their own individual files, which can be a useful tool for understanding what information the authority holds about them. If a request to review files is denied or significantly delayed, tenants and applicants may consider contacting the housing authority's administrative office to ask for a written explanation, or reaching out to a local tenant-rights organization for guidance on next steps. Keep in mind that the authority is permitted to withhold materials related to confidential law enforcement investigations into possible criminal misconduct by the requesting individual, so some records may lawfully be unavailable.
