Wyo. Stat. Ann. §§ 40-26-101 to 40-26-145 § 40-26-141
Effect of relief granted.
Operative Text
40-26-141. Effect of relief granted. Relief granted under W.S. 40-26-139 through 40-26-143 does not affect a contract, sale, encumbrance or lease that is consummated before the granting of the relief and involves a bona fide purchaser, encumbrancer or tenant who did not have actual notice of the filing of a complaint or civil action under this chapter.
Wyoming Statute § 40-26-141 establishes a protective boundary for certain third parties who entered into contracts, sales, encumbrances, or leases before a court or agency granted relief in a housing discrimination case. Specifically, if a bona fide purchaser, lender, or tenant completed their transaction without actual notice that a complaint or civil action had been filed under this chapter, any relief granted under §§ 40-26-139 through 40-26-143 cannot undo or override that transaction. The rule balances the interests of discrimination victims against the interests of innocent third parties who acted in good faith without knowledge of pending proceedings.
Plain English — not legal advice.
Under § 40-26-141, property owners and managers should be aware that once a complaint or civil action is filed under Wyoming's fair housing chapter, any transactions completed after that point may be subject to any relief ultimately granted. Compliant operators generally maintain awareness of any pending fair housing complaints tied to their properties, since a bona fide third party's protection under this section hinges on their lack of actual notice — not the landlord's. Keeping accurate records of when complaints are filed and ensuring that subsequent transactions are handled transparently are practices consistent with operating under this statutory framework.

Section § 40-26-141 is relevant to tenants who may be affected by a housing discrimination proceeding involving a property they occupy or seek to occupy. If a tenant entered into a lease before relief was granted and did so without actual notice of a pending complaint or civil action under this chapter, that lease is generally shielded from being unwound by the relief order. Tenants who believe their housing situation intersects with a fair housing complaint may find it useful to consult a tenant-rights organization or legal aid provider to understand how this provision interacts with their specific lease circumstances.
