Wyo. Stat. Ann. §§ 40-26-101 to 40-26-145 § 40-26-130
Election of judicial determination.
Operative Text
40-26-130. Election of judicial determination. A complainant, a respondent, or an aggrieved person on whose behalf a complaint was filed may elect to have the claims asserted in the charge decided in a civil action as provided by W.S. 40-26-136. The election shall be made not later than the twentieth day after the date the person having the election receives service under W.S. 40-26-126(b) or, in the case of the enforcing authority, not later than the twentieth day after the date the charge is issued. The person making the election shall give notice to the enforcing authority and to all other complainants and respondents to whom the charge relates.
Under Wyoming's fair housing law, Wyo. Stat. § 40-26-130, any party involved in a housing discrimination complaint — whether the person who filed it, the person it was filed against, or someone on whose behalf it was filed — has the right to move the dispute out of the administrative process and into a civil court instead. This election must be made within twenty days of receiving the required notice under the statute, or, for the enforcing authority, within twenty days of the charge being issued. Once the election is made, all other parties to the charge must be notified of that choice.
Plain English — not legal advice.
As a respondent under Wyo. Stat. § 40-26-130, a property owner or manager who receives a fair housing charge has a defined window — generally twenty days from service of notice under W.S. 40-26-126(b) — to decide whether to have the matter resolved through a civil court action rather than an administrative proceeding. Operators who are aware of this deadline typically track the date of service carefully, since the election right is lost if the window closes without action. Compliant practice also includes promptly notifying the enforcing authority and all other parties if the civil court path is chosen.

Under Wyo. Stat. § 40-26-130, a complainant or aggrieved person on whose behalf a fair housing charge was filed has the right to elect a civil court proceeding instead of an administrative one, but that right must be exercised within twenty days of receiving service under W.S. 40-26-126(b). Tenants who believe they have a fair housing claim may want to understand this timeline and their options by consulting a tenant-rights organization or legal aid provider familiar with Wyoming fair housing law. If the election is made, the statute requires that notice be given to the enforcing authority and to all other parties named in the charge.
