Wyo. Stat. Ann. §§ 40-26-101 to 40-26-145 § 40-26-122
Conciliation.
Operative Text
40-26-122. Conciliation. The enforcing authority shall, during the period beginning with the filing of a complaint and ending with the filing of a charge or a dismissal by the enforcing authority, to the extent feasible, engage in conciliation with respect to the complaint. A conciliation agreement between a respondent and the complainant is subject to enforcing authority approval. A conciliation agreement may provide for binding arbitration or another method of dispute resolution. Dispute resolution that results from a conciliation agreement may authorize appropriate relief, including monetary relief.
Wyoming Statute § 40-26-122 establishes that once a fair housing complaint is filed, the enforcing authority is required to attempt conciliation — a facilitated resolution process — between the parties for as long as the complaint remains open and before any formal charge or dismissal is issued. Any agreement reached through conciliation must be approved by the enforcing authority to take effect. Such an agreement can include binding arbitration or other dispute-resolution methods, and any resulting resolution may include monetary or other appropriate relief for the affected party.

Under § 40-26-122, a respondent named in a fair housing complaint may have the opportunity to reach a negotiated resolution through the conciliation process before a formal charge is filed. Operators who participate in good faith in conciliation discussions, and who reach a written agreement approved by the enforcing authority, can resolve complaints through binding arbitration or other agreed-upon methods. Any conciliation agreement that includes monetary or other relief becomes enforceable once the enforcing authority grants its approval.

Section § 40-26-122 gives complainants the right to participate in a conciliation process after filing a fair housing complaint, during which the enforcing authority works to facilitate a resolution between the parties. A conciliation agreement can include monetary relief and may use binding arbitration or other dispute-resolution mechanisms, all subject to enforcing authority approval. Tenants who have filed a complaint may wish to consult a tenant-rights organization or legal aid provider to understand what types of relief may be available through the conciliation process under this provision.
