Cal. Civ. Code § 704.96
Campground occupants and guests.
Operative Text
704.96 Campground occupants and guests. (1) This chapter does not apply to an occupant, guest, or guest of an occupant or guest of a campground or camping resort licensed under s. 97.67. (2) This section does not affect rights related to individuals in a manufactured and mobile home community, as defined in s. 66.0435 (1) (cg), or rights related to individuals who enter into a campground contract, as defined in s. 707.02 (6).
Wisconsin Statute § 704.96 carves out a specific group of people from the state's general landlord-tenant law (Chapter 704): occupants, guests, and guests of guests at campgrounds or camping resorts that hold a license under Wis. Stat. § 97.67. At the same time, the provision clarifies that it does not disturb the separate legal rights of residents in manufactured and mobile home communities or of people who enter into campground contracts as defined elsewhere in Wisconsin law. In effect, the provision draws a boundary between recreational camping relationships and the more formal landlord-tenant relationships governed by Chapter 704.
Plain English — not legal advice.
Operators of campgrounds or camping resorts licensed under Wis. Stat. § 97.67 should be aware that § 704.96 places their occupants and guests outside the scope of Wisconsin's standard landlord-tenant statute, meaning the notice requirements, eviction procedures, and other tenant protections in Chapter 704 generally do not govern those relationships. Compliant campground operators typically look to their licensing framework under § 97.67 and any applicable campground-specific regulations rather than Chapter 704 when managing occupancy matters. Operators who also host manufactured or mobile home community residents, or who offer campground contracts under Wis. Stat. § 707.02(6), should recognize that § 704.96 expressly preserves the distinct legal rights applicable to those arrangements.
General guidance for property managers — not legal advice for your specific situation. Consult an attorney for advice on your case.
If you are staying at a Wisconsin campground or camping resort licensed under Wis. Stat. § 97.67, § 704.96 makes clear that the standard tenant protections found in Chapter 704—such as formal eviction procedures and notice requirements—do not apply to your stay. However, if you reside in a manufactured or mobile home community, or if you have entered into a campground contract as defined under Wis. Stat. § 707.02(6), § 704.96 preserves whatever separate rights attach to those arrangements. Individuals who believe their rights under those distinct frameworks have been affected may wish to consult a tenant-rights organization or legal aid service familiar with Wisconsin housing law for general information about available options.
