Cal. Civ. Code § 704.10
Electronic delivery.
Operative Text
704.10 Electronic delivery. A rental agreement may include a provision that permits the landlord to provide and indicate agreement by electronic means any of the following: (1) A copy of the rental agreement and any document related to the rental agreement. (2) A security deposit and any documents related to the accounting and disposition of the security deposit and security deposit refund. (3) A promise made before the initial rental agreement to clean, repair, or otherwise improve any portion of the premises. (4) Advance notice of entry under s. 704.05 (2).
Wisconsin Statute § 704.10 allows rental agreements to include a clause authorizing landlords to deliver certain documents and communications electronically rather than in paper form. The types of materials that may be sent this way include the rental agreement itself, security deposit documents, pre-tenancy promises about repairs or improvements, and advance entry notices required under § 704.05(2). Importantly, this is an opt-in arrangement — the rental agreement must specifically contain a provision permitting electronic delivery for it to apply.
Plain English — not legal advice.
Under Wis. Stat. § 704.10, landlords who wish to use electronic delivery for lease documents, security deposit accounting, repair promises, or entry notices should ensure their rental agreement explicitly includes a clause authorizing that method. Compliant operators typically obtain clear electronic consent within the agreement itself before relying on digital transmission for any of the listed document types. Maintaining records of electronic delivery — such as sent emails or platform confirmations — is a common practice that supports documentation of compliance.

Wis. Stat. § 704.10 means that a landlord can only deliver documents like lease copies, security deposit records, and entry notices electronically if the rental agreement itself contains a provision allowing it. Tenants who did not agree to electronic delivery through their rental agreement may have grounds to question whether a digitally delivered notice or document was properly provided. Tenant-rights organizations in Wisconsin can help clarify whether a specific rental agreement's language satisfies the requirements of § 704.10.
