Cal. Civ. Code § 66.1019
Housing codes to conform to state law.
Operative Text
66.1019 Housing codes to conform to state law. (1) One- and 2-family dwelling code. Ordinances enacted by any county, city, village or town relating to the construction and inspection of one- and 2-family dwellings shall conform to subch. II of ch. 101. (2) Modular home code. Ordinances enacted by any county, city, village or town relating to the on-site inspection of the installation of modular homes shall conform to subch. III of ch. 101. (2m) Manufactured homes. (a) Ordinances enacted, or resolutions adopted, on or after January 1, 2007, by any county, city, village, or town relating to manufactured home installation shall conform to s. 101.96. (b) If a city, village, town, or county has in effect on or after January 1, 2007, an ordinance or resolution relating to manufactured home installation that does not conform to s. 101.96, the ordinance or resolution does not apply and may not be enforced.
Wisconsin Stat. § 66.1019 establishes that local governments — counties, cities, villages, and towns — cannot set their own independent standards for certain residential construction and installation matters. Specifically, local ordinances covering one- and two-family dwellings must align with state law under Subchapter II of Chapter 101, modular home installation inspections must conform to Subchapter III of Chapter 101, and manufactured home installation rules must conform to § 101.96. Any local manufactured home ordinance or resolution that conflicts with § 101.96 and was enacted on or after January 1, 2007, is rendered void and unenforceable by operation of this provision.
Plain English — not legal advice.
Under Wis. Stat. § 66.1019, property owners and managers working with one- and two-family dwellings, modular homes, or manufactured homes should be aware that the controlling construction and installation standards are set at the state level, not by local ordinance. Compliant operators typically verify that any permits, inspections, or installation work they arrange are evaluated against the applicable state standards — Subchapter II or III of Chapter 101, or § 101.96 — rather than a potentially superseded local code. When a local jurisdiction attempts to apply a manufactured home installation ordinance that post-dates January 1, 2007, and conflicts with § 101.96, that ordinance has no legal force under this provision.

Wis. Stat. § 66.1019 means that tenants living in one- and two-family homes, modular homes, or manufactured homes in Wisconsin have the benefit of uniform statewide construction and installation standards, regardless of which municipality they live in. If a local government attempts to enforce a manufactured home installation rule that conflicts with § 101.96 and was adopted on or after January 1, 2007, that rule is void under this provision. Tenants who believe a local code enforcement action is based on a nonconforming ordinance may wish to consult a tenant-rights organization or legal aid office familiar with Wisconsin housing law to understand what options may be available.
