Wisconsin Administrative Code § SPS 326.31 governs how sewer and water charges may be calculated and billed to residents of manufactured home communities. The rule permits billing based on metered usage, a flat rate, residential equivalent units, or any other method that can be demonstrated to reasonably distribute costs among residents. No single method is mandated, but whatever approach is used must fall within one of these recognized categories.

For Property Managers

Under § SPS 326.31, operators of manufactured home communities in Wisconsin are expected to select a sewer and water billing method that fits within the four permitted categories — metered, flat rate, residential equivalent units, or a demonstrably reasonable alternative allocation method. Compliant operators typically document the chosen method and can show, if questioned, that it reasonably distributes utility costs among occupants. Choosing a method outside these categories, or one that cannot be shown to reasonably allocate costs, would fall outside the rule's allowances.

For Tenants

Section § SPS 326.31 establishes that manufactured home community residents in Wisconsin have a right to be billed for sewer and water using only an approved method — metered usage, flat rate, residential equivalent units, or another approach that demonstrably allocates costs fairly. If a resident believes their utility billing does not conform to any of these permitted methods, they may raise this as a concern with Wisconsin's Department of Safety and Professional Services or consult a tenant-rights organization familiar with manufactured housing regulations. Reviewing billing statements against the method disclosed by the community operator is a common starting point for understanding whether the charges align with § SPS 326.31.
