SPS 326.28 Information available and required to be provided to customers. Each manufactured home community operator or manufactured home community contractor shall have available and provide, to all new manufactured home community occupants and to any manufactured home community occupant making a request, a written notice that includes a summary of the rules set forth in this chapter pertaining to deposits, payment options, disconnection, and dispute procedures. The notice shall contain a reply procedure to allow manufactured home community occupants an opportunity to advise the manufactured home community operator or manufactured home community contractor of any special circumstances, such as the presence of infants or elderly persons or the use of human life-sustaining equipment, and to advise the manufactured home community operator or manufactured home community contractor to contact a specific third-party agency or individual prior to any disconnection action being taken. Each manufactured home community operator or manufactured home community contractor shall also provide annually, and any time rates are increased, written information regarding the rates charged to manufactured home community occupants for the provision of water and sewer service. The information provided shall include a description of how rates are determined, the rate charged the manufactured home community operator or manufactured home community contractor by its water or sewer service provider, and the department’s telephone number.
Wisconsin Administrative Code § SPS 326.28 requires operators and contractors of manufactured home communities to maintain and distribute a written notice summarizing key rules on deposits, payment options, disconnection, and dispute procedures. This notice must include a way for residents to report special circumstances—such as the presence of infants, elderly individuals, or life-sustaining medical equipment—so that a designated third party can be contacted before any disconnection occurs. Separately, operators and contractors must provide written rate information at least once a year and whenever rates increase, including how rates are set, what the operator pays its water or sewer provider, and the Wisconsin Department of Safety and Professional Services' contact number.

Under § SPS 326.28, compliant manufactured home community operators and contractors keep a written summary of chapter rules—covering deposits, payment options, disconnection, and dispute procedures—ready to hand to every new occupant and to any current occupant who asks. The notice must include a reply mechanism so occupants can flag sensitive situations, such as households with infants, elderly residents, or life-sustaining equipment, and can designate a third-party contact to be notified before disconnection. Operators and contractors also issue written rate disclosures at least annually and each time rates change, detailing the rate methodology, the pass-through cost from the water or sewer provider, and the department's telephone number.

§ SPS 326.28 gives manufactured home community occupants the right to receive a written summary of the rules governing deposits, payment options, disconnection, and dispute procedures—both when they first move in and upon request at any later time. Occupants also have the right to use the notice's reply procedure to inform the operator or contractor of special household circumstances, such as the use of life-sustaining medical equipment, and to name a specific third party who must be contacted before any disconnection action is taken. If an operator or contractor fails to provide required rate disclosures or the written notice described in § SPS 326.28, occupants may consider reaching out to the Wisconsin Department of Safety and Professional Services or a local tenant-rights organization to understand available options.
