Operative Text
DWD 220.25 Filing of documents by facsimile transmission or electronic mail. (1) Filing of documents by facsimile transmission. (a) Except where otherwise directed by the division, documents may be filed by facsimile transmission. Documents filed by facsimile transmission shall include a cover sheet setting forth all of the following information: 1. The name of the sender. 2. The individual to whom the transmission is directed, if that individual is known. 3. The number of pages being transmitted, including the cover sheet. (b) The date of transmission recorded by the division’s facsimile machine shall constitute the date of filing of a document under this section, except that documents filed by facsimile after the regular business hours of the division as established by s. 230.35 (4) (f), Stats., or on a day when the offices of the division are closed pursuant to s. 230.35 (4) (a), Stats., shall be considered filed on the next business day of the division. (2) Filing of documents by electronic mail. Documents may be filed by electronic mail only if expressly authorized by the equal rights officer or the administrative law judge assigned to the case.
Wisconsin Administrative Code § DWD 220.25 establishes the rules for submitting documents to the Wisconsin Department of Workforce Development (DWD) Division of Equal Rights by fax or email. Fax filings are generally permitted and must include a cover sheet with the sender's name, the intended recipient's name (if known), and the total page count. The filing date is the date the division's fax machine records receipt, except that transmissions arriving outside regular business hours or on closed days are treated as filed on the next business day. Email filing is only allowed when the equal rights officer or the assigned administrative law judge has expressly authorized it for a particular case.
Plain English — not legal advice.
Property owners or managers involved in a proceeding before the DWD Division of Equal Rights should be aware that § DWD 220.25 governs how documents may be submitted by fax or email. A compliant filer using fax includes a properly completed cover sheet and transmits during the division's regular business hours to ensure the filing date is recorded on the intended day. Email submission requires advance authorization from the equal rights officer or administrative law judge assigned to the matter before any documents are sent that way.

Tenants participating in a DWD Division of Equal Rights proceeding have the ability under § DWD 220.25 to file documents by fax without special permission, provided the required cover sheet information is included. It is worth noting that faxes sent after business hours or on days the division is closed will be dated as filed on the next business day, which could affect deadlines. Tenants who wish to file by email should first confirm whether the equal rights officer or administrative law judge has authorized that method for their case; tenant-rights organizations can help explain how these procedural rules apply generally.
