If no probable cause is found, the complaint is dismissed and all parties are notified of the right to appeal under § DWD 220.09.

Under Wis. Admin. Code § DWD 220.08, property owners and managers who are the subject of a housing discrimination complaint can expect a written initial determination from the DWD at the close of its investigation. Compliant operators typically maintain thorough records of their rental practices, communications, and decision-making processes so that accurate facts are available during the investigation period. If the determination finds no probable cause, the complaint is dismissed; if probable cause is found, the matter proceeds to a formal charge under § DWD 220.11.

Wis. Admin. Code § DWD 220.08 establishes that after the DWD investigates a housing discrimination complaint, it must issue a written decision explaining the factual basis for its conclusion. If the department finds probable cause, the case advances toward a formal charge; if it finds no probable cause and dismisses the complaint, tenants and complainants have the right to appeal that decision as outlined in § DWD 220.09. Tenants who receive a no-probable-cause determination may wish to review the appeal process or consult a tenant-rights organization to understand available next steps.
