Cal. Civ. Code § ATCP 134.10
Effect of rules on local ordinances.
Operative Text
ATCP 134.10 Effect of rules on local ordinances. (1) This chapter does not prohibit or nullify any local government ordinance with which it is not in direct conflict as provided in sub. (2). (2) In the event of any direct conflict between this chapter and any local government ordinance, such that compliance with one can only be achieved by violating the other, this chapter shall be controlling. (3) Compliance with local government ordinances shall not relieve any person from the duty of complying with this chapter.
Wisconsin Administrative Code § ATCP 134.10 establishes how the state's residential rental rules interact with local ordinances. Local rules that do not directly conflict with ATCP 134 can remain in effect alongside the state code. However, when a genuine, irreconcilable conflict exists between a local ordinance and ATCP 134, the state code takes precedence, and satisfying a local rule does not excuse anyone from also meeting the state's requirements.
Plain English — not legal advice.
Under § ATCP 134.10, property owners and managers operating in Wisconsin must comply with ATCP 134 regardless of what any local ordinance requires. Compliant operators generally review both state and local rules to identify any areas of overlap or conflict, understanding that meeting a city or county rule does not automatically satisfy the state code. Where a direct conflict exists, operators generally default to the standard set by ATCP 134.

Section ATCP 134.10 means that tenants in Wisconsin retain the protections of the state code even in jurisdictions that have their own rental ordinances. If a landlord claims that compliance with a local rule excuses non-compliance with ATCP 134, that argument is not supported by this provision. Tenants who believe their rights under ATCP 134 have been violated may consider contacting a local tenant-rights organization or the Wisconsin Department of Agriculture, Trade and Consumer Protection, which administers this chapter, to understand available options.
