W. Va. C.S.R. § 87-1-1 et seq. § §87-1-13
Emergency Vehicle Permits
Operative Text
§ 87-1-13. Emergency Vehicle Permits.
13.1. Authorization for all fire department vehicles and firefighters to operate Class A vehicles shall
be designated by their fire chief and the State Fire Marshal's Office. Vehicles authorized by W. Va. Code
§ 17C-15-26 shall have red flashing warning lights and an audible signaling device, such as a siren, whistle
or bell capable of emitting sound audible from a distance of not less than 500 feet.
13.2. Upon receipt of written notification from the Fire Chief of the local fire department to the State
Fire Marshal requesting that an Emergency Vehicle Permit be revoked, the State Fire Marshal shall cause
the permit to be revoked.West Virginia Code of State Rules § 87-1-13 establishes the framework for authorizing and revoking emergency vehicle permits for fire department vehicles. Under this provision, authorization to operate Class A vehicles must come from both the fire chief and the State Fire Marshal's Office, and any vehicle covered by W. Va. Code § 17C-15-26 must be equipped with red flashing warning lights and an audible signaling device—such as a siren, whistle, or bell—audible from at least 500 feet away. Additionally, the State Fire Marshal is required to revoke a permit upon receiving written notification from the local fire chief requesting that revocation.

This provision, W. Va. C.S.R. § 87-1-13, governs fire department emergency vehicle operations rather than landlord-tenant relationships directly, but property owners who manage facilities housing fire department operations or who coordinate with local fire departments should be aware that vehicle authorization flows through the fire chief and the State Fire Marshal's Office. Compliant operators familiar with fire safety infrastructure generally ensure that any fire department vehicles associated with their facilities meet the required equipment standards, including red flashing warning lights and audible signaling devices meeting the 500-foot threshold. Understanding the permit revocation process outlined in § 87-1-13.2 can be relevant when managing properties with on-site fire suppression or emergency response resources.

While W. Va. C.S.R. § 87-1-13 primarily addresses fire department vehicle permitting rather than tenant rights, tenants who have concerns about emergency vehicle access to their residential property or fire safety compliance may find it useful to understand that authorization and revocation of these permits runs through the local fire chief and the West Virginia State Fire Marshal's Office. If a tenant believes that emergency vehicle access or fire safety equipment at their residence is inadequate, they can contact the State Fire Marshal's Office, which oversees permit administration under § 87-1-13. Tenant-rights organizations or local housing authorities may also be able to help identify whether related fire safety standards apply to a specific residential situation.
