Wash. Rev. Code § 59.28 § 59.28.050
Owner's rights -- Public regulatory powers -- Applicability.
Operative Text
This chapter shall not in any way prohibit an owner of federally assisted housing from terminating a rental assistance contract or prepaying a mortgage or loan. The requirement in this chapter for notice shall not be construed as conferring any new or additional regulatory power upon the city or county clerk or upon the department of commerce.
Washington's Wash. Rev. Code § 59.28.050 makes clear that the notice requirements established elsewhere in Chapter 59.28 do not strip owners of federally assisted housing of their underlying rights to end rental assistance contracts or pay off mortgages and loans early. At the same time, the provision specifies that the chapter's notice rules do not grant any new regulatory authority to city or county clerks or to the Washington Department of Commerce. In other words, the chapter creates informational obligations without reshaping the legal powers of either property owners or government agencies.
Plain English — not legal advice.
Under Wash. Rev. Code § 59.28.050, owners of federally assisted housing retain the right to terminate rental assistance contracts or prepay mortgages and loans, even while the broader Chapter 59.28 imposes notice requirements. Compliant operators generally understand that meeting those notice obligations does not mean they have surrendered any ownership or contractual rights that existed before the chapter's requirements applied. Familiarity with both the notice duties and this preservation-of-rights clause helps operators navigate federally assisted housing transitions with a clearer picture of what the law does and does not restrict.

Wash. Rev. Code § 59.28.050 clarifies that while Chapter 59.28 requires owners of federally assisted housing to provide certain notices, those notice rules do not give city or county clerks or the Department of Commerce any new power to block an owner's decision to exit a rental assistance program or pay off a mortgage early. Tenants in federally assisted housing should be aware that the notice protections in Chapter 59.28 are primarily informational, giving residents advance warning of potential changes rather than preventing those changes outright. Tenants who believe required notices were not properly provided may wish to consult a tenant-rights organization or legal aid provider familiar with Washington's affordable housing laws to understand what remedies, if any, may be available.
