Wash. Rev. Code § 59.21 § 59.21.050
Relocation fund -- Administration -- Tenant's application -- Form.
Operative Text
(1)(a) The existence of the manufactured/mobile home park relocation fund in the custody of the state treasurer is affirmed. (b) Expenditures from the fund may only be used as follows: (i) Except as provided in subsection (3) of this section, all moneys received from the fee as specified in RCW 46.17.155 must be used only for relocation assistance awarded under this chapter. (ii) All moneys received from the fee as specified in RCW 59.30.050 must be used only for the relocation coordination program created in RCW 59.21.120 . (c) Only the director or the director's designee may authorize expenditures from the fund. All relocation payments to tenants shall be made from the fund. The fund is subject to allotment procedures under chapter 43.88 RCW, but no appropriation is required for expenditures. (2) A tenant is eligible for relocation assistance under this chapter only after an application is submitted by that tenant or an organization acting on the tenant's account under RCW 59.21.021 (5) on a form approved by the director. The application shall include: (a) A copy of the notice from the park-owner, or other adequate proof, that the tenancy is terminated due to closure of the park or its conversion to another use; (b) a copy of the rental agreement then in force, or other proof that the applicant was a tenant at the time of notice of closure; (c) proof of ownership of the home at the time of notice of closure; (d) a statement, on a form approved by the department, of whether the tenant will transfer title of the home to the park-owner or relocate the home within 90 days of receiving relocation assistance; and (e) other information as may be required by the department to process the application. (3) The department may deduct a percentage amount of the fee collected under RCW 46.17.155 for administration expenses incurred by the department.
Washington's Revised Code § 59.21.005 et seq. § 59.21.050 establishes and affirms the existence of a state-managed relocation fund held by the state treasurer, specifically to help manufactured and mobile home park tenants who are displaced when a park closes or converts to another use. Fees collected under designated statutes flow into this fund and are restricted to relocation assistance or a relocation coordination program, with only the director or their designee authorized to approve expenditures. To access assistance, a displaced tenant must submit a formal application—including proof of tenancy, park closure notice, and home ownership—along with a statement indicating whether they plan to relocate the home or transfer its title to the park owner within 90 days of receiving funds.

Under § 59.21.050, park owners who are closing or converting a manufactured/mobile home park play a key role in triggering the relocation assistance process: the closure notice they provide to tenants becomes a required document in each tenant's application to the fund. Compliant operators typically ensure that closure notices are clear, written, and sufficient to serve as proof of termination of tenancy, since tenants must attach a copy or equivalent documentation to their applications. Keeping records of rental agreements and notices in good order supports the administrative process that the state fund depends on.

To be eligible, you or an organization acting on your behalf must submit an application approved by the director, including your closure notice, rental agreement, and proof that you owned your home at the time of the notice.
