Wash. Rev. Code § 43.185A § 43.185A.070
Monitor recipient activities.
Operative Text
(1) To the extent funds are appropriated for this purpose, the director shall monitor the activities of recipients of grants and loans under this chapter to determine compliance with the terms and conditions set forth in its application or stated by the department in connection with the grant or loan. (2) Personally identifiable information of occupants or prospective tenants of affordable housing or the street address of the residential real property occupied or applied for by tenants or prospective tenants of affordable housing, obtained by the department of commerce during monitoring activities or contract administration are exempt from inspection and copying under RCW 42.56.395 .
Under Wash. Rev. Code § 43.185A.070, the Washington Department of Commerce is authorized—when funds are appropriated for the purpose—to monitor organizations that receive housing grants or loans under this chapter to verify they are meeting the terms of their agreements. Separately, the provision establishes a privacy protection: personal identifying information about tenants or prospective tenants of affordable housing, as well as the street addresses of their residences, gathered during monitoring or contract administration, are shielded from public records disclosure under Washington's Public Records Act. This means that routine oversight of grant and loan recipients does not expose sensitive tenant data to the general public.
Plain English — not legal advice.
Organizations and property owners that receive grants or loans administered under Wash. Rev. Code § 43.185A.070 are generally expected to maintain records and cooperate with Department of Commerce monitoring activities that verify compliance with application terms and departmental conditions. Compliant recipients typically keep documentation demonstrating adherence to the specific requirements attached to their funding. Because the department's monitoring activities are subject to appropriation, operators should be aware that oversight intensity may vary depending on available state funding.

Wash. Rev. Code § 43.185A.070 provides a meaningful privacy protection for people living in or applying for affordable housing funded through this chapter: personal identifying information and residential addresses collected by the Department of Commerce during oversight activities are exempt from public disclosure under Washington's Public Records Act. This means that a tenant's or prospective tenant's sensitive information gathered in the course of grant or loan monitoring generally cannot be obtained by members of the public through a records request. Tenants who believe their protected information has been improperly disclosed may wish to consult a tenant-rights organization or legal aid provider familiar with Washington housing and public records law.
