Utah Admin. Code R392-402-13 establishes the authority of a local health officer to close or restrict access to a manufactured home community, housing site, or individual space when it is deemed an imminent risk to public life, health, or safety. Once such a closure or restriction is ordered, the community operator is required to limit public access to the affected area within a timeframe set by the health officer. No part of a closed or restricted area may be returned to use until the local health officer provides written approval.

For Property Managers

Under R392-402-13, compliant operators of manufactured home communities act promptly when a local health officer issues a closure or restriction order, securing the affected area and preventing public access within the timeframe specified in the order. Operators generally maintain documentation of all communications with the local health officer, including the original order and any subsequent written approvals before reopening. Allowing residents or the public to use any area deemed unfit for use—without written clearance from the local health officer—constitutes a violation of this provision.

For Tenants

R392-402-13 gives local health officers the power to close or restrict portions of a manufactured home community that pose an imminent risk to health or safety, which can directly affect a resident's access to their home or site. If a tenant believes a closure has been improperly ordered, prolonged without justification, or that an operator is failing to comply with a health officer's directives, they may contact the local health department to inquire about the status of the order and any written approvals. Tenant-rights organizations and legal aid services can help residents understand what options may be available when a closure or restriction affects their housing situation.
