Utah Admin. Code R392-402 § R392-402-12
Inspections and Investigations.
Operative Text
R392-402-12. Inspections and Investigations.
(1)(a) Upon presenting proper identification, the operator shall permit the local health officer to enter upon the
premises of a manufactured home community to perform inspections, investigations, reviews, and other actions as necessary to
ensure compliance with this rule.
(b) The local health officer may not enter an occupied manufactured home without the express permission of the
occupant except when a warrant is issued to a duly authorized public safety officer that authorizes the local health officer to enter,
or when the operator and the local health officer determine that there exists an imminent risk to the life, health, or safety of the
occupant.Utah Admin. Code R392-402-12 establishes the conditions under which local health officers may enter a manufactured home community to check for compliance with state rules. While operators must allow inspections of the community's common premises upon presentation of proper identification, the rule draws a firm line at the door of individual occupied homes: entry into a resident's home requires either the resident's express permission, a valid warrant, or a determination by both the operator and health officer that an imminent threat to life, health, or safety exists. This provision balances the state's interest in community-wide oversight with residents' privacy rights within their own homes.
Plain English — not legal advice.
Under R392-402-12, a compliant manufactured home community operator generally maintains a practice of granting access to local health officers who present proper identification, allowing them to inspect, investigate, and review the community's premises as needed. Operators also understand that their own consent to a health officer's entry does not extend to occupied homes — resident permission, a warrant, or a documented imminent-safety determination is required before a health officer may cross that threshold. Keeping clear records of inspection visits and any imminent-risk determinations is a practice consistent with operating transparently under this rule.

R392-402-12 gives residents of manufactured home communities a meaningful privacy protection: a local health officer generally cannot enter your occupied home without your express permission, unless a warrant has been issued or both the operator and health officer have determined there is an imminent risk to life, health, or safety. If a resident believes this boundary has been crossed without proper justification, that concern can be raised with the local health department, a tenant-rights organization, or reviewed in the context of any enforcement action. Residents who want to understand how this rule applies to a specific situation may benefit from consulting a tenant-rights organization familiar with Utah manufactured housing regulations.
