Utah Code § 57-21 § 57-21-4
Conduct and requirements excluded -- Defenses.

(1) Except as provided in Subsections 57-21-5(4) and (5), this chapter does not:
(a) require a person to exercise a higher degree of care toward an individual who has a disability than toward an individual who does not have a disability;
(b) relieve a person of an obligation generally imposed on all persons regardless of disability in a written lease, rental agreement, contract of purchase or sale, mortgage, trust deed, or other financing agreement; or
(c) prohibit any program, service, facility, or privilege intended to habilitate, rehabilitate, or accommodate an individual with a disability.
(2) (a) It is a defense to a complaint or action brought under this chapter that the complainant has a disability that, in the circumstances and even with reasonable accommodation, poses a serious threat to the health or safety of the complainant or others.
(b) The respondent bears the burden of proving a defense in accordance with Subsection (2)(a).

Plain English

Utah Code Ann. § 57-21-4 carves out several areas that Utah's fair housing law does not reach. It does not require anyone to hold a person with a disability to a lower standard of care than others, does not excuse anyone from obligations already set out in a lease or financing agreement, and does not block programs specifically designed to help people with disabilities. Separately, the law recognizes a defense when a complainant's disability—even with reasonable accommodation—poses a serious threat to health or safety, but the burden of proving that defense falls on the party asserting it.

For Property Managers

Under Utah Code Ann. § 57-21-4, compliant housing operators generally understand that standard lease obligations apply equally to all residents regardless of disability status, and that offering disability-specific programs or services is expressly permitted rather than prohibited. Operators who wish to raise the 'direct threat' defense in a fair housing proceeding should be aware that § 57-21-4(2)(b) places the burden of proof squarely on the respondent—meaning the housing provider—to substantiate that claim. Documenting the factual basis for any such defense thoroughly and contemporaneously is a practice commonly associated with compliance in this area.

For Tenants

Utah Code Ann. § 57-21-4 preserves tenants' existing lease obligations while also making clear that housing providers cannot use this chapter to impose a higher standard of care on residents with disabilities. If a housing provider raises the 'serious threat' defense against a fair housing complaint, § 57-21-4(2)(b) requires the provider—not the tenant—to carry the burden of proving that claim. Tenants who believe their rights under Utah's fair housing law have been affected by this provision may consider contacting the Utah Antidiscrimination and Labor Division, a local tenant-rights organization, or the U.S. Department of Housing and Urban Development to explore available complaint processes.
