Operative Text
Utility service to mobile home parks -- Limitation on providers' charges. Local water, sewer, and sanitation entities, including those administered by municipalities and counties which provide water, sewer, or garbage collection services shall not receive a greater percentage net return from supplying a mobile home park than said entity receives from other residential customers. The net return is determined by taking into consideration the costs of maintenance and depreciation of the mobile home park facilities and all savings on administrative costs, including cost of billing residents.
Utah Code Ann. § 57-16-10 limits what local water, sewer, and sanitation providers—including those run by municipalities and counties—can earn from serving mobile home parks. Specifically, the percentage net return a utility receives from a mobile home park cannot exceed what it earns from other residential customers. Net return is calculated by factoring in maintenance and depreciation costs for the park's facilities, as well as any administrative savings such as reduced billing costs.
Plain English — not legal advice.
Under Utah Code Ann. § 57-16-10, mobile home park operators may have grounds to challenge utility billing arrangements if a local water, sewer, or sanitation provider appears to be extracting a higher net return from the park than from other residential customers. Compliant park operators generally keep records of utility charges and compare them against publicly available rate structures for other residential accounts. When administrative savings—such as consolidated billing—are present, those savings are factored into the net return calculation under this provision.

Utah Code Ann. § 57-16-10 establishes that residents of mobile home parks are protected from utility providers profiting disproportionately from their community compared to other residential customers. If a tenant believes a local water, sewer, or sanitation entity is charging rates that result in a higher net return from the park than from other residential areas, that concern can be raised with the relevant municipal or county utility authority. Tenants may also consult a tenant-rights organization or legal aid provider familiar with Utah mobile home park law to understand what options may be available under this provision.
