Tex. Prop. Code Ann. §§ 94.001–94.303 § 94.303
CUMULATIVE REMEDIES.
Operative Text
Sec. 94.303. CUMULATIVE REMEDIES. (a) The provisions of this chapter are not exclusive and are in addition to any other remedy provided by other law.(b) A specific remedy provided by this chapter supersedes the general remedy provided by this subchapter and is in addition to any other remedy provided by other law. Added by Acts 2001, 77th Leg., ch. 801, Sec. 1, eff. April 1, 2002.
Section 94.303 of the Texas Property Code establishes that the remedies available under Chapter 94 (which governs manufactured home communities) are cumulative rather than exclusive. This means that a person who has a claim under Chapter 94 is not limited to only the remedies that chapter provides — they may also pursue any other remedies available under other applicable laws. Where Chapter 94 provides a specific remedy for a particular situation, that specific remedy takes precedence over the chapter's general remedies, while still leaving open any additional remedies available elsewhere in the law.
Plain English — not legal advice.
Under Tex. Prop. Code § 94.303, operators of manufactured home communities should be aware that residents and other parties are not restricted to a single legal avenue when disputes arise. A compliant operator generally maintains records and practices that account for the possibility that a claimant may pursue remedies under Chapter 94 alongside remedies available under other Texas or federal laws. Understanding that specific Chapter 94 remedies supersede general ones — without eliminating other legal options — helps operators anticipate the full scope of potential claims they may face.

Section 94.303 of the Texas Property Code means that as a resident of a manufactured home community, you are not limited to only the remedies spelled out in Chapter 94 when seeking to address a violation. You may be able to pursue claims under other Texas laws or applicable federal laws in addition to those provided by Chapter 94. Tenant-rights organizations or legal aid services familiar with manufactured home community law can help you understand the range of remedies that may be available in a given situation.
