LANDLORD'S MAINTENANCE OBLIGATIONS.
Operative Text
Sec. 94.152. LANDLORD'S MAINTENANCE OBLIGATIONS. The landlord shall:(1) comply with any code, statute, ordinance, and administrative rule applicable to the manufactured home community;(2) maintain all common areas, if any, of the manufactured home community in a clean and useable condition;(3) maintain all utility lines installed in the manufactured home community by the landlord unless the utility lines are maintained by a public utility or political subdivision, including a municipality;(4) maintain individual mailboxes for the tenants in accordance with United States Postal Service regulations unless mailboxes are permitted to be located on the tenant's manufactured home lot;(5) maintain roads in the manufactured home community to the extent necessary to provide access to each tenant's manufactured home lot;(6) provide services for the common collection and removal of garbage and solid waste from within the manufactured home community; and(7) repair or remedy conditions on the premises that materially affect the physical health or safety of an ordinary tenant of the manufactured home community. Added by Acts 2001, 77th Leg., ch. 801, Sec. 1, eff. April 1, 2002.
Under Tex. Prop. Code § 94.152, operators of manufactured home communities are required to keep common areas clean and usable, maintain landlord-installed utility lines, provide garbage collection, keep roads passable, and repair conditions that materially threaten the health or safety of residents. Landlords must also maintain individual mailboxes in compliance with U.S. Postal Service rules unless mailboxes are permitted on individual lots. The provision establishes a baseline set of physical and operational standards that apply to the community as a whole, not just individual lots.
Plain English — not legal advice.
Operators of manufactured home communities subject to Tex. Prop. Code § 94.152 generally document routine inspections of common areas, roads, and landlord-installed utility lines to demonstrate ongoing compliance. Compliant operators also coordinate regular garbage and solid waste removal services and address any conditions that could materially affect tenant health or safety in a timely manner. Maintaining records of repairs, service contracts, and mailbox compliance with U.S. Postal Service regulations supports a clear operational record.

Tex. Prop. Code § 94.152 establishes that tenants in manufactured home communities have a right to common areas, roads, utility lines, mailboxes, and garbage services that meet the standards described in the provision. When a landlord fails to repair conditions that materially affect health or safety, tenants may have grounds to raise that failure as a legal defense or pursue a complaint through local code enforcement or housing authorities. Tenant-rights organizations familiar with Texas manufactured housing law can help residents understand which general enforcement paths may be available to them.
