Tex. Prop. Code Ann. §§ 94.001–94.303 § 94.103
OBLIGATION TO REFUND.
Operative Text
Sec. 94.103. OBLIGATION TO REFUND. (a) Except as provided by this subchapter, the landlord shall refund the security deposit not later than the 30th day after the date the tenant surrenders the manufactured home lot.(b) A requirement that a tenant give advance notice of surrender as a condition for refunding the security deposit is effective only if the requirement is underlined or is printed in conspicuous bold print in the lease.(c) The tenant's claim to the security deposit takes priority over the claim of any creditor of the landlord, including a trustee in bankruptcy. Added by Acts 2001, 77th Leg., ch. 801, Sec. 1, eff. April 1, 2002.
Under Texas Property Code § 94.103, a landlord who rents a manufactured home lot is generally required to return the tenant's security deposit within 30 days after the tenant surrenders the lot. Any lease clause requiring advance notice of surrender as a condition of refund is only enforceable if that clause is underlined or printed in conspicuous bold print. Additionally, a tenant's claim to the security deposit takes legal priority over the claims of the landlord's creditors, including a bankruptcy trustee.
Plain English — not legal advice.
Under § 94.103, operators of manufactured home lot communities are generally expected to process security deposit refunds within the 30-day window that begins when a tenant surrenders the lot. If a lease includes an advance-notice-of-surrender requirement tied to the deposit refund, compliant operators ensure that clause is visually distinguished through underlining or conspicuous bold print — otherwise the requirement carries no legal weight. Keeping clear records of the surrender date and any deductions helps demonstrate compliance with the statutory timeline.

Section 94.103 of the Texas Property Code gives manufactured home lot tenants a right to receive their security deposit back within 30 days of surrendering the lot, subject to any lawful deductions. If your lease contains an advance-notice requirement related to the deposit, that clause is only binding if it was underlined or printed in conspicuous bold print — a tenant may be able to raise the absence of that formatting as a defense if a landlord withholds a refund on that basis. Tenants who believe a deposit has been wrongfully withheld can explore options such as contacting a tenant-rights organization or reviewing remedies available under the broader Texas Property Code Chapter 94 framework.
