Plain English

Under Texas Property Code § 94.011, when a tenant in a manufactured home community files a lawsuit to enforce a landlord's legal obligations, the law establishes who can be served with legal process on the owner's behalf. If the owner has not provided the tenant with the owner's name and a business street address in writing, then the management company, on-site manager, or rent collector automatically qualifies as the owner's authorized agent for service of process. This rule ensures that a tenant is not blocked from pursuing legal action simply because the property owner's direct contact information is unknown.

For Property Managers

Under § 94.011, operators of manufactured home communities in Texas can control how legal process is served by furnishing tenants with the owner's name and a business street address in writing. Without that written disclosure, the management company, on-site manager, or rent collector is treated by law as the owner's authorized agent for service of process. Compliant operators typically maintain clear, written records of ownership disclosures provided to tenants to avoid unintended service through on-site personnel.

For Tenants

Section 94.011 of the Texas Property Code gives tenants in manufactured home communities a practical path to serve legal process on a landlord even when the owner's direct contact information is unavailable. If the owner's name and business street address have not been provided to you in writing, the on-site manager, management company, or rent collector can be served as the owner's authorized agent. Tenants who want to understand how this affects a potential lawsuit may benefit from consulting a tenant-rights organization or legal aid provider familiar with Texas manufactured housing law.
