Tex. Prop. Code Ann. §§ 94.001–94.303 § 94.008
MANUFACTURED HOME COMMUNITY RULES.
Operative Text
Sec. 94.008. MANUFACTURED HOME COMMUNITY RULES. (a) A landlord may adopt manufactured home community rules that are not arbitrary or capricious.(b) Manufactured home community rules are considered part of the lease agreement.(c) The landlord may add to or amend manufactured home community rules. If the landlord adds or amends a rule:(1) the rule is not effective until the 30th day after the date each tenant is provided with a written copy of the added or amended rule; and(2) if a tenant is required to take any action that requires the expenditure of funds in excess of $25 to comply with the rule, the landlord shall give the tenant at least 90 days after the date each tenant is provided with a written copy of the added or amended rule to comply with the rule. Added by Acts 2001, 77th Leg., ch. 801, Sec. 1, eff. April 1, 2002.
Under Texas Property Code § 94.008, landlords who operate manufactured home communities are permitted to establish community rules, provided those rules are not arbitrary or capricious. Any such rules are legally treated as part of the lease agreement itself. When a landlord adds or changes a rule, it cannot take effect until at least 30 days after tenants receive a written copy; if the new or amended rule requires a tenant to spend more than $25 to comply, the landlord must allow at least 90 days for compliance.
Plain English — not legal advice.
Under § 94.008, operators of manufactured home communities who adopt, add to, or amend community rules generally ensure those rules have a rational, non-arbitrary basis and are delivered to each tenant in writing. Compliant operators track the date written notice is provided and do not enforce a new or amended rule before the 30-day waiting period expires. When a rule change would require a tenant to spend more than $25 to comply, operators typically allow the full 90-day compliance window before taking any enforcement action.

Section 94.008 of the Texas Property Code establishes that community rules form part of your lease, but also limits how and when a landlord can enforce new or changed rules. If a landlord attempts to enforce a rule change before the required 30-day notice period — or before 90 days when compliance costs exceed $25 — that premature enforcement may be raised as a defense in a dispute. Tenants who believe a rule is arbitrary, capricious, or improperly noticed may wish to consult a tenant-rights organization or legal aid provider familiar with Texas manufactured home community law.
