CASH RENTAL PAYMENTS.
Operative Text
Sec. 94.007. CASH RENTAL PAYMENTS. (a) A landlord shall accept a tenant's cash rental payment unless the lease agreement requires the tenant to make rental payments by check, money order, or other traceable or negotiable instrument.(b) A landlord who receives a cash rental payment shall:(1) provide the tenant with a written receipt; and(2) enter the payment date and amount in a record book maintained by the landlord.(c) A tenant or a governmental entity or civic association acting on the tenant's behalf may file suit against a landlord to enjoin a violation of this section. Added by Acts 2001, 77th Leg., ch. 801, Sec. 1, eff. April 1, 2002.
Under Texas Property Code § 94.007, a landlord in a manufactured home community must generally accept cash as a form of rent payment, unless the lease specifically requires payment by check, money order, or another traceable or negotiable instrument. When cash is accepted, the landlord is required to give the tenant a written receipt and to log the payment date and amount in a record book. This rule creates a documented paper trail for cash transactions, protecting both parties in any future dispute over payment history.
Plain English — not legal advice.
Operators subject to Tex. Prop. Code § 94.007 who accept cash rent payments are expected to issue a written receipt to the tenant at the time of each cash payment and to record the date and amount in a dedicated record book. If a property's lease agreement requires payment exclusively by check, money order, or another traceable instrument, that lease term can lawfully eliminate the obligation to accept cash. Maintaining consistent documentation practices for every cash transaction helps demonstrate compliance with the statute's recordkeeping requirements.

Section 94.007 of the Texas Property Code gives tenants in manufactured home communities the right to pay rent in cash unless their lease explicitly limits payment to checks, money orders, or similar instruments. When a landlord accepts cash, tenants are entitled to a written receipt and can expect the payment to be logged in the landlord's records — documentation that can be valuable if a payment dispute arises. Under subsection (c), a tenant, or a governmental entity or civic association acting on a tenant's behalf, may file suit to stop a landlord from violating this section; tenant-rights organizations can help explain what options may be available.
