Tex. Prop. Code Ann. §§ 94.001–94.303 § 94.005
COMMON AREA FACILITIES.
Operative Text
Sec. 94.005. COMMON AREA FACILITIES. Each common area facility, if any, must be open or available to tenants. The landlord shall post the hours of operation or availability of the facility in a conspicuous place at the facility. Added by Acts 2001, 77th Leg., ch. 801, Sec. 1, eff. April 1, 2002.
Under Texas Property Code § 94.005, any common area facility within a manufactured home community must be accessible to all tenants rather than restricted or closed off. Additionally, the landlord is required to post the facility's hours of operation or availability in a noticeable location at the facility itself. This rule applies to any such shared amenity that exists on the property, though it does not require a landlord to provide common area facilities in the first place.
Plain English — not legal advice.
Property owners and managers operating manufactured home communities under Tex. Prop. Code § 94.005 generally ensure that any shared amenity — such as a laundry room, clubhouse, or recreational area — remains open and accessible to all tenants during stated hours. A compliant operator posts the hours of operation or availability in a conspicuous spot at or near the facility, such as on the entrance door or an adjacent bulletin board. Keeping posted hours current and accurate is part of ongoing compliance with this section.

Under Tex. Prop. Code § 94.005, tenants in a manufactured home community have a right to access any common area facilities that exist on the property, and those facilities must have their hours posted in a visible location at the site. If a facility is being withheld from tenant use or hours are not posted as required, tenants may document the issue and consider raising it with local code enforcement or a tenant-rights organization familiar with Texas manufactured housing law. Consulting a tenant advocacy group can help clarify what remedies or complaint processes may be available under this provision.
