Under Tex. Prop. Code § 94.004, a landlord generally cannot enter a tenant's manufactured home without either the tenant's in-person consent at the time of entry or prior written consent that specifies an exact date and time. Written consent is only valid for the specific date and time stated, and the tenant may cancel it at any time by notifying the landlord in writing. Two exceptions exist: a landlord may enter without consent in an emergency or when the tenant has abandoned the manufactured home.

For Property Managers

Tex. Prop. Code § 94.004 requires that operators of manufactured home communities obtain either real-time consent from a present tenant or written consent that names a specific date and time before entering a tenant's home. Compliant operators keep records of any written consent forms and treat a written revocation from the tenant as immediately effective. Entry without consent is only appropriate when a genuine emergency arises or when the home has been abandoned, and operators generally document the circumstances in either case.

For Tenants

Tex. Prop. Code § 94.004 gives manufactured home tenants meaningful control over who enters their home: a landlord must have your in-person permission or a written consent form that names the exact date and time. If you have given written consent, you can cancel it at any time simply by notifying the landlord in writing, and no penalty can be imposed for doing so. Tenants who believe a landlord has entered without proper authorization may wish to document the incident, review the statute, and consider reaching out to a local tenant-rights organization or legal aid office for guidance on available options.
