Tex. Prop. Code Ann. §§ 54.041–54.048, 54.901 § 54.047
OTHER RIGHTS NOT AFFECTED.
Operative Text
Sec. 54.047. OTHER RIGHTS NOT AFFECTED. This subchapter does not affect or diminish any other rights or obligations arising under common law or any statute. Added by Acts 1985, 69th Leg., ch. 305, Sec. 1, eff. Aug. 26, 1985.
Section 54.047 of the Texas Property Code establishes that the landlord's lien subchapter operates alongside, rather than in place of, other legal rights and duties. Any rights or obligations that exist under common law or other statutes remain fully intact and are not reduced or eliminated by this subchapter. In other words, this provision functions as a savings clause, preserving the broader legal landscape that surrounds landlord-tenant lien matters.
Plain English — not legal advice.
Under § 54.047, property owners and managers should understand that complying with the landlord's lien subchapter does not exhaust their legal obligations — duties arising from other statutes or common law principles still apply. Operators who follow the lien procedures in §§ 54.041–54.048 are not thereby shielded from claims rooted in other areas of law, such as contract or tort. Compliant operators typically review all applicable legal frameworks, not just the lien subchapter, when addressing disputes over property or unpaid rent.

Section 54.047 means that tenants retain any rights they may have under common law or other statutes even when a landlord invokes the lien procedures found in this subchapter. A tenant who believes a landlord has acted improperly is not limited to arguments arising solely from §§ 54.041–54.048 — other legal theories and protections may still be available. Tenants seeking to understand the full scope of their rights in a lien-related situation may benefit from consulting a tenant-rights organization or reviewing other applicable Texas statutes.
