Section 24.0042 of the Texas Property Code establishes how deadlines are counted under Chapter 24, which governs eviction (forcible entry and detainer) proceedings. The day that triggers a deadline is not counted, but Saturdays, Sundays, and state or federal holidays are included in the count—unless the final day of a period falls on one of those days, in which case the deadline automatically shifts to the next regular business day. This rule applies uniformly to all time periods prescribed by Chapter 24, effective January 1, 2026.

For Property Managers

Property owners and managers handling eviction-related notices and filings under Chapter 24 generally track deadlines carefully using the counting method established in § 24.0042: starting the count on the day after the triggering event, including weekends and holidays in the tally, and noting when a deadline falls on a weekend or holiday so they can recognize that it extends to the next business day. Operators familiar with this rule tend to build their notice and filing timelines around it to avoid procedural missteps. Consulting a licensed Texas attorney when preparing eviction-related documents is a common practice among compliant operators.

For Tenants

Under § 24.0042, tenants involved in Chapter 24 eviction proceedings benefit from the same deadline-counting rules that apply to all parties—meaning a deadline that lands on a Saturday, Sunday, or holiday automatically moves to the next business day, which can affect how long a tenant has to respond to a notice or court filing. Understanding how these time periods are calculated can be important when reviewing any notice received from a landlord. Tenant-rights organizations and legal aid services in Texas can help explain how § 24.0042 applies to specific notices or court deadlines a tenant may be facing.
