REGULATION OF MANUFACTURED HOME COMMUNITIES.
Operative Text
Sec. 214.906. REGULATION OF MANUFACTURED HOME COMMUNITIES. (a) "Manufactured home" has the meaning assigned by Section 1201.003, Occupations Code.(b) Notwithstanding any other law, the governing body of a municipality may not regulate a tract or parcel of land as a manufactured home community, park, or subdivision unless the tract or parcel contains at least four spaces offered for lease for installing and occupying manufactured homes. Added by Acts 2017, 85th Leg., R.S., Ch. 741 (S.B. 1248), Sec. 2, eff. September 1, 2017.
Texas Local Government Code § 214.906 limits when a municipality may classify and regulate a piece of land as a manufactured home community, park, or subdivision. Specifically, a local government's regulatory authority under this framework applies only when the tract or parcel contains at least four spaces that are offered for lease for the purpose of installing and occupying manufactured homes. Tracts with fewer than four such leasable spaces fall outside this particular municipal regulatory category, regardless of other local ordinances that might otherwise apply.

Under § 214.906, operators of manufactured home communities in Texas should be aware that municipal regulation of their property as a manufactured home community, park, or subdivision is only permissible when the property includes at least four spaces offered for lease for manufactured home installation and occupancy. Owners of smaller properties—those with fewer than four leasable spaces—generally fall outside this specific regulatory classification. Compliant operators of qualifying communities typically maintain clear records of the number of leasable spaces to accurately determine which municipal regulations apply to their property.

Section 214.906 of the Texas Local Government Code establishes a threshold that affects whether a municipality can regulate the land where a tenant lives as a manufactured home community. If the property has fewer than four spaces offered for lease, it may not qualify for regulation under this classification, which could affect what local rules and protections apply to residents there. Tenants who have questions about how their community is classified and what protections may be available to them can reach out to a local tenant-rights organization or consult the Texas State Law Library for guidance on applicable regulations.
