Section 121.003 of the Texas Human Resources Code establishes that people with disabilities have the same right to use public facilities, housing, and transportation as people without disabilities. The law prohibits outright denial of access, as well as subtler forms of exclusion such as ruses or failures to make reasonable accommodations or provide auxiliary aids. It also protects the right to use assistance animals, wheelchairs, white canes, and other assistive devices without being charged extra, and it shields those animals from assault or interference.

For Property Managers

Under Tex. Hum. Res. Code § 121.003, housing providers who offer rentals or leases in Texas are generally expected to provide full and equal access to tenants and applicants with disabilities. Compliant operators typically make reasonable accommodations in their policies and practices, supply necessary auxiliary aids, and permit the use of service or assistance animals without charging extra compensation or a deposit for the animal—though they may hold the tenant liable for damages beyond normal wear and tear. Facility staff may ask only the two narrow questions permitted under § 121.003(l) when a disability is not readily apparent, and may not demand certifications or other qualifications for a service animal.

For Tenants

Tex. Hum. Res. Code § 121.003 gives tenants with disabilities the right to full and equal access to housing accommodations offered for rent or lease in Texas, including the right to keep a service or assistance animal without paying extra fees or deposits. If a housing provider refuses access, imposes extra charges related to a disability or assistive device, or fails to make reasonable accommodations, those actions may constitute prohibited discrimination under this section. Tenants who believe their rights under § 121.003 have been violated can document the conduct, reach out to a tenant-rights organization, or explore filing a complaint with a relevant state or federal agency.
