Operative Text
Sec. 2306.939. INTERAGENCY COOPERATION. (a) The department shall identify other state agencies that may interact with occupants of migrant housing facilities to assist the department in identifying and locating unlicensed migrant labor housing facilities.(b) Information provided to the department under this section:(1) may be used only for the purposes of identifying and locating unlicensed migrant labor housing facilities;(2) must be free of identification information relating to individual migrant agricultural workers; and(3) is confidential and not subject to disclosure under Chapter 552. Added by Acts 2025, 89th Leg., R.S., Ch. 695 (S.B. 243), Sec. 1, eff. September 1, 2025.
Section 2306.939 of the Texas Government Code establishes a framework for state agencies to work together to help the Texas Department of Housing and Community Affairs (TDHCA) find migrant labor housing facilities that are operating without a required license. Any information shared between agencies for this purpose must be stripped of personally identifying details about individual migrant agricultural workers, and that information is treated as confidential — meaning it is not subject to public disclosure under Texas's open-records law. The provision is focused solely on regulatory compliance and facility identification, not on the individuals living in those facilities.
Plain English — not legal advice.
Operators of migrant labor housing facilities in Texas should be aware that under Sec. 2306.939, multiple state agencies may now coordinate to identify and locate facilities that lack proper licensure. A compliant operator generally maintains a current license issued through the TDHCA and keeps documentation readily available to demonstrate that status. Because this interagency cooperation mechanism is specifically designed to surface unlicensed operations, licensed operators benefit from ensuring their records with the department remain up to date.

Migrant agricultural workers living in housing facilities have a protection built into Sec. 2306.939: any information shared between state agencies to locate unlicensed facilities must not include personally identifying details about individual residents. This means the interagency process is designed to target non-compliant facilities, not to expose or track the people living in them, and shared data is kept confidential under state law. Residents who have concerns about whether their housing facility is properly licensed may reach out to tenant-rights organizations or contact the TDHCA directly to learn more about the licensing requirements that apply to migrant labor housing.
