RETALIATION PROHIBITED.
Operative Text
Sec. 2306.937. RETALIATION PROHIBITED. A person who owns, establishes, maintains, operates, or otherwise provides a migrant labor housing facility, a person who employs a migrant agricultural worker who occupies a migrant labor housing facility, or a farm labor contractor may not retaliate against a person for filing a complaint or providing information in good faith relating to a possible violation of this subchapter. Added by Acts 2025, 89th Leg., R.S., Ch. 695 (S.B. 243), Sec. 1, eff. September 1, 2025.
Section 2306.937 of the Texas Government Code prohibits retaliation against anyone who files a complaint or provides information in good faith about a possible violation of the migrant labor housing subchapter. This protection applies regardless of whether the complaint ultimately proves valid, as long as it was made in good faith. The rule covers actions by facility owners and operators, employers of migrant agricultural workers housed at such facilities, and farm labor contractors.

Under Tex. Gov't Code § 2306.937, operators of migrant labor housing facilities, employers of migrant agricultural workers, and farm labor contractors are expected to refrain from any adverse action against a worker or other person who reports a potential housing violation in good faith. Compliant operators generally maintain clear, non-retaliatory policies and ensure that supervisors and managers understand that complaints about housing conditions are protected activity. Documenting the legitimate, independent basis for any employment or housing decisions that follow a complaint is a practice commonly associated with compliance in this area.

Tex. Gov't Code § 2306.937 gives migrant agricultural workers and others the right to report potential housing violations without fear of retaliation from facility operators, employers, or farm labor contractors. If you believe you have experienced retaliation for making a good-faith complaint, options generally include filing a complaint with a relevant state agency, raising the retaliation as a defense in any proceeding brought against you, or contacting a tenant-rights or farmworker-advocacy organization for guidance. Keeping records of complaints made and any subsequent adverse actions can be relevant when pursuing these paths.
