DEVELOPMENT ACCESSIBILITY.
Operative Text
Sec. 2306.6722. DEVELOPMENT ACCESSIBILITY. Any development supported with a housing tax credit allocation shall comply with the accessibility standards that are required under Section 504, Rehabilitation Act of 1973 (29 U.S.C. Section 794), and specified under 24 C.F.R. Part 8, Subpart C. Added by Acts 2001, 77th Leg., ch. 1367, Sec. 8.01, eff. Sept. 1, 2001.
Under Texas Government Code § 2306.6722, any residential development that receives a housing tax credit allocation must meet the federal accessibility standards established by Section 504 of the Rehabilitation Act of 1973 and detailed in 24 C.F.R. Part 8, Subpart C. These standards are designed to ensure that federally assisted housing is accessible to people with disabilities. The rule applies at the development level, meaning the physical design and construction of the property must conform to these requirements as a condition of receiving the tax credit funding.

Operators and developers seeking or holding a housing tax credit allocation under § 2306.6722 are generally expected to incorporate Section 504 and 24 C.F.R. Part 8, Subpart C accessibility requirements into the design, construction, and ongoing management of their properties. Compliant operators typically conduct accessibility reviews during the planning phase, ensure that the required percentage of units and common areas meet the specified standards, and maintain documentation demonstrating ongoing compliance. Familiarity with the Texas Department of Housing and Community Affairs' oversight processes is a practical part of managing a tax-credit property subject to this provision.

Tenants living in or applying to housing developments that received a housing tax credit allocation have a right to expect that the property meets the federal accessibility standards referenced in § 2306.6722, including those under Section 504 of the Rehabilitation Act of 1973. If a tenant believes a property is not meeting these accessibility requirements, general enforcement paths include filing a complaint with the U.S. Department of Housing and Urban Development or contacting a local tenant-rights or disability-rights organization for guidance. Tenants may also raise a violation of § 2306.6722 as part of a broader fair housing or Section 504 complaint process.
