Under Tenn. Comp. R. & Regs. 0770-03-02 § 0770-03-02-.15, property owners participating in Section 8 housing assistance programs are required to maintain dwelling units in decent, safe, and sanitary condition and to provide all services and utilities agreed upon in the contract. The administering Agency must inspect each covered unit at least once a year and may inspect more frequently based on complaints or other concerns. If an owner fails to correct identified deficiencies within the time specified in a notice, the Agency may suspend housing assistance payments or terminate the contract for the affected unit, even while the family remains in occupancy.

Owners operating under Tenn. Comp. R. & Regs. 0770-03-02 § 0770-03-02-.15 are generally expected to continuously provide all contracted services, utilities, and maintenance throughout the term of the housing assistance contract. Compliant operators typically respond promptly to Agency inspection findings and complete any required corrective actions within the timeframe specified in the Agency's notice, including addressing conditions caused by the tenant family. Failure to do so can result in abatement of housing assistance payments or termination of the contract on the affected unit, regardless of whether the family remains in place.

Under Tenn. Comp. R. & Regs. 0770-03-02 § 0770-03-02-.15, tenants in Section 8-assisted units have a right to live in housing that is maintained in decent, safe, and sanitary condition with all contracted utilities and services provided. Tenants may bring complaints about unit conditions to the Agency's attention, which the Agency is required to consider when scheduling inspections. If the Agency terminates a contract due to the owner's failure to maintain the unit and the family was not at fault, the Agency must assist the family in finding alternative Section 8 housing in accordance with 24 CFR 882.517(f); tenant-rights organizations can help explain what that assistance process generally involves.
