Operative Text
(1) Time of Execution. (a) Upon acceptance of the unit(s) by the Agency and acceptance of the certifications by the Agency the Contract will be executed by the Owner and the Agency. The effective date must be no earlier than the Agency inspection which provides the basis for acceptance. (2) Changes from Agreement. (a) The Contract Rents may be higher or lower than those specified in the Agreement in accordance with requirements of 0770-3-1-.07. (3) Unleased Unit(s). (a) At the time of execution of the Contract, the Agency will examine the lists of dwelling units leased and not leased, and will determine whether or not the Owner has met the obligations with respect to any unleased unit(s) and for which unit(s) it will make vacancy payments if the unit(s) is not leased within 15 days. The Owner must indicate in writing either concurrence with this determination or disagreement, reserving all rights to claim vacancy payments for the unleased unit(s) pursuant to the Contract, without prejudice by reason of the Owner’s signing the Contract. Authority: T.C.A. §13-23-115(18). Administrative History: Original rule filed July 13, 1982; effective August 12, 1982.
Under Tenn. Comp. R. & Regs. 0770-03-02 et seq. § 0770-03-02-.07, a Housing Assistance Payments (HAP) Contract between a housing agency and a property owner becomes effective only after the agency has inspected and accepted the dwelling unit(s) and reviewed the owner's certifications. The contract rents established at signing may differ from those outlined in the original agreement, subject to separate regulatory requirements. The provision also sets out a process for addressing units that remain unleased at the time of contract execution, including a 15-day window after which vacancy payments may apply.

Tenn. Comp. R. & Regs. 0770-03-02 et seq. § 0770-03-02-.07 outlines the steps a compliant owner generally follows when executing a HAP Contract: ensuring the agency has completed its inspection and accepted all certifications before the contract's effective date is established. Owners also review and reconcile any differences between the contract rents and those stated in the original agreement in accordance with the applicable cross-referenced rule. For any units still unleased at execution, compliant operators provide a written statement either concurring with or disputing the agency's determination, preserving their right to claim vacancy payments without waiving any contractual protections.

Tenn. Comp. R. & Regs. 0770-03-02 et seq. § 0770-03-02-.07 governs how and when a HAP Contract takes effect, which can affect the availability and timing of housing assistance tied to a particular unit. Tenants in assisted housing may find it useful to understand that the agency's inspection and acceptance of a unit is a prerequisite to the contract's effective date, meaning assistance cannot begin before that inspection occurs. Those with questions about how this process affects their specific housing assistance arrangement may wish to contact their local housing agency or a tenant-rights organization for general guidance.
