Cal. Civ. Code § 0770-03-01-.12
SUBCONTRACTING OF OWNER SERVICES.
Operative Text
(1) General. Any Owner may contract with any private or public entity to perform for a fee the services required by the Agreement, Contract or Lease, provided that such contract may not shift any of the Owner’s responsibilities or obligations. (2) Public Housing Authority Management. If the Owner and a Public Housing Authority wish to enter into a management contract, they may do so provided that the Agency is administering the rental assistance program and approves. Authority: T.C.A. §13-23-115 (18). Administrative History: Original rule filed July 13, 1982; effective August 12, 1982.
Under Tenn. Comp. R. & Regs. 0770-03-01 § 0770-03-01-.12, a property owner participating in a covered rental assistance program may hire a third party—whether a private company or a public entity—to carry out services required by the governing agreement or lease, but doing so does not transfer the owner's underlying legal responsibilities to that third party. A separate provision addresses arrangements specifically between an owner and a Public Housing Authority, which require approval from the administering Agency before taking effect. In both cases, the owner remains the accountable party under the program.

Owners operating under Tenn. Comp. R. & Regs. 0770-03-01 § 0770-03-01-.12 who choose to subcontract management or other required services generally ensure that any such arrangement is documented and that the contract language makes clear the owner retains full program obligations. When the intended subcontractor is a Public Housing Authority, compliant operators typically seek and obtain Agency approval before the management contract becomes operative. Maintaining records of subcontracting agreements and approval correspondence supports ongoing compliance with this provision.

Tenn. Comp. R. & Regs. 0770-03-01 § 0770-03-01-.12 means that even if a property is managed by a third-party company or a Public Housing Authority rather than the owner directly, the owner's obligations under the lease or rental assistance agreement remain in force. Tenants who experience service failures or believe program requirements are not being met may raise this provision to underscore that the owner cannot use a management contract as a shield against accountability. Tenant-rights organizations and the Agency administering the rental assistance program are potential resources for understanding how to pursue a concern under this rule.
