Under Tenn. Comp. R. & Regs. 0770-01-05 et seq. § 0770-01-05-.05, certain individuals connected to the Tennessee Housing Development Agency (THDA) or its subcontract agencies—including officers, policy-influencing employees, relevant public officials, and members of the U.S. Congress—are barred from holding a direct or indirect financial interest in a Section 8 housing assistance payment contract. This prohibition applies during a covered person's tenure in their role and extends for one year after that tenure ends. The THDA retains the ability to seek a waiver from HUD when circumstances are found to warrant one.

For Property Managers

Property owners and managers participating in Tennessee's Section 8 programs should be aware that Tenn. Comp. R. & Regs. 0770-01-05 et seq. § 0770-01-05-.05 disqualifies certain categories of individuals—such as THDA officers, policy-influencing employees, relevant public officials, and congressional members—from serving as owners or participants in housing assistance payment contracts. Compliant operators generally review the backgrounds of any ownership-interest holders to confirm that no such conflicts exist before entering into or renewing a Section 8 contract. Awareness of the one-year post-tenure restriction is also part of maintaining ongoing eligibility under this rule.

For Tenants

Tenn. Comp. R. & Regs. 0770-01-05 et seq. § 0770-01-05-.05 establishes conflict-of-interest protections designed to keep government insiders from personally benefiting from the Section 8 programs they oversee or influence. Tenants who believe a landlord or program participant may be violating this provision can raise the concern with the THDA directly or consult a tenant-rights organization familiar with Tennessee housing law. Understanding this rule can also be relevant when evaluating the integrity of program administration in a particular housing situation.
