Operative Text
In establishing or approving rent structures the Agency will provide for rents, which together with other monies legally available to the Agency or the housing sponsor with respect to the housing development, will be sufficient to meet the debt service, maintenance and operational requirements of the housing development and in circum- stances appropriate for limited profits a return on equity. Only rents established or approved by the Agency from time to time may be charged for dwelling units in housing developments financed by an Agency mortgage loan. Authority: T.C.A. §13--23--115 (18). Administrative History: Original rule filed September 19, 1975, effective October 19, 1975.
Under Tenn. Comp. R. & Regs. 0770-01-04 § 0770-01-04-.07, the Tennessee Housing Development Agency (THDA) holds authority over the rent structures in housing developments it finances through mortgage loans. Rents must be set at levels sufficient to cover debt service, maintenance, and operational costs, and may include a limited return on equity where appropriate. No rent may be charged in an Agency-financed development unless it has been established or approved by the Agency.
Plain English — not legal advice.
Property owners and managers operating housing developments financed by a THDA mortgage loan are expected, under § 0770-01-04-.07, to charge only those rents that the Agency has formally established or approved. Compliant operators typically work directly with the Agency when setting or adjusting rent schedules, ensuring that proposed rents cover required costs such as debt service and maintenance. Charging rents outside of Agency-approved structures is not permitted under this provision.

Tenants living in housing developments financed by a THDA mortgage loan have a right, under § 0770-01-04-.07, to be charged only rents that the Agency has established or approved — landlords cannot unilaterally set rents outside that framework. If a tenant believes they are being charged a rent that was never approved by the Agency, they may consider contacting the Tennessee Housing Development Agency directly to inquire about the approved rent schedule for their development. Tenant-rights organizations familiar with state-financed housing programs can also help residents understand what recourse may be available.
