Operative Text
(1) Rules of Practice for design standards, other physical standards, site selection, and development for housing devel- opments financed by Agency mortgage loans may be established, modified, amended and promulgated from time to time pursuant to Rule 0770--1--1--.02 of these Rules and Regulations. (2) The Agency may also establish Rules of Practice setting forth standards regarding the number of persons permitted to live in a dwelling unit and other standards relating to occupancy and maintenance of dwelling units. Authority: T.C.A. §13--23--115 (18). Administrative History: Original rule filed September 19, 1975, effective October 19, 1975.
Tenn. Comp. R. & Regs. 0770-01-04 et seq. § 0770-01-04-.06 grants the Tennessee Housing Development Agency the authority to create and update rules governing physical design standards, site selection, and occupancy limits for housing developments it finances. These rules can address how many people may live in a given dwelling unit, as well as maintenance requirements. The provision itself is an enabling framework, meaning the specific standards it authorizes may be issued, revised, or replaced over time through the Agency's rulemaking process.

Property owners and managers overseeing developments financed by Agency mortgage loans should be aware that Tenn. Comp. R. & Regs. 0770-01-04 et seq. § 0770-01-04-.06 empowers the Tennessee Housing Development Agency to set and update design, occupancy, and maintenance standards applicable to those properties. Compliant operators generally monitor Agency rulemaking for any new or amended Rules of Practice that affect their developments, since standards on matters such as occupancy limits can be modified over time. Staying current with Agency-issued guidance helps ensure that physical conditions and occupancy practices remain aligned with applicable requirements.

Tenants living in housing financed by the Tennessee Housing Development Agency should know that Tenn. Comp. R. & Regs. 0770-01-04 et seq. § 0770-01-04-.06 authorizes the Agency to establish standards governing how many people may occupy a dwelling unit and how units must be maintained. If a tenant believes occupancy limits or maintenance conditions in their unit do not meet applicable Agency standards, general enforcement paths can include contacting the Agency directly, raising the issue with a local housing authority, or consulting a tenant-rights organization familiar with Agency-financed housing. Because the specific rules issued under this provision can change over time, reviewing current Agency Rules of Practice is a useful starting point for understanding what standards apply.
